Descriply is a web-based application that provides users with the ability to generate customized job descriptions on demand. The Service is provided on an "as-is" and "as-available" basis, with no guarantee of compliance with laws and regulations, accuracy, completeness, or timeliness of the information provided.
To access and use the Service, you must be at least 18 years old. By creating an account or using the Service, you confirm that you are at least 18 years of age and have the legal capacity to enter into these Terms.
You may be required to create an account ("Account") with a username, password, and other relevant information to access and use the Service. You are responsible for maintaining the confidentiality of your Account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your Account or password.
All job descriptions and other content generated through the Service ("Content") are the property of Descriply. Users are granted a non-exclusive, non-transferable, revocable license to use the Content for their business purposes. You acknowledge that the Content may contain errors or inaccuracies, and Descriply disclaims any liability for any such errors, inaccuracies, or omissions.
The Service and its original content, features, and functionality are and will remain the exclusive property of Descriply and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Descriply.
Your use of the Service is at your sole risk. The Service is provided on an "as-is" and "as-available" basis. Descriply expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
In no event shall Descriply, its affiliates, directors, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any errors, inaccuracies, or omissions in the Content; or (iii) any other matter relating to the Service.
You agree to indemnify, defend, and hold harmless Descriply, its affiliates, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service or your violation of these Terms.
Descriply reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms.
We reserve the right to terminate or suspend your Account, with or without notice, for any reason, including, but not limited to, your violation of these Terms. Upon termination, your right to access and use the Service will immediately cease. Any Content associated with your Account may be deleted or retained at our sole discretion.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through arbitration, in accordance with the rules of the American Arbitration Association, or through any other alternative dispute resolution method agreed upon by the parties.
These Terms shall be governed and construed in accordance with the laws of Florida, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
We reserve the right, at our sole discretion, to modify, suspend, or discontinue the Service at any time, for any reason, with or without notice. You agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
